Building and Housing Board of Appeals

Note: This Board is included in the City of Stockton's Conflict of Interest Code and members are required to disclose economic interests held within the jurisdiction of the Board/Commission, by completing a Statement of Economic Interests Form 700 when appointed, as required by the Fair Political Practices Commission (FPPC) and the City of Stockton.

All investments, interests in real property and income, and any business entity in which the person is a director, officer, partner, trustee, employee, or holds any position of management. Financial interests are reportable only if located within or subject to the jurisdiction of the City of Stockton or if the business entity is doing business or planning to do business in the jurisdiction or has done business within the jurisdiction at any time during the two years prior to filing the statement.

Function:

  • To hear and decide appeals of administrative decisions, including, but not limited to, denials of requests to use alternative methods of providing access to public accommodations by physically handicapped persons as required by the California, Part 5.5 (Section 19955, et seq.)
  • The Board may approve, disapprove or modify Building Division interpretations of Part 5.5 of Division 13 of the Health and Safety Code (Section 19955 et seq.) including the exceptions contained in Section 19957, and enforce actions taken by the Building Division.

 

Legal Authority:

Board established by Stockton Municipal Code Section 13-204, Sec. 14-405 (new code section 15.04.140). Amended by Ordinance No. 11-95 C.S. - July 12, 1995, Section 13-204 (new code sec. 15.04.140); and, Ordinance No. 026-07 C.S. - November 27, 2007, Chapter 13 sections 13-204, 13-204.1, 13-204.2, 13-204.3, subsections A and B.1, 13-204.4, 13-205, 13-212, subsection F, and 13-213, subsection A, (new code sections 15.04.140).

2 from the lay community

A member shall be neither an elected officer nor an employee of the City of Stockton, but he/she shall not be disqualified by membership on or employment by any other board, commission, agency or authority of, or created by or for the City of Stockton.
